Uganda opposition politician Dr Kiiza Besigye and his aide Obeid Lutale have been sent back to Luzira Maximum Prison following the hearing of his application at the High Court.
The case challenges his continued detention by the Military Court despite a Supreme Court ruling declaring the trial of civilians in the court martial illegal.
Besigye’s lawyers filed an application in the High Court demanding an explanation from the Attorney General and prison authorities on his continued detention. He was brought to court in Kampala amid heavy security.
The High Court declined to continue with the case citing the poor health of Dr Besigye who appeared weak and frail.
The opposition politician has been on hunger strike for over a week now, protesting his illegal detention.
This week he was taken to a private clinic in Kampala after his family requested his personal doctor to attend to him.
This further fuels concerns from his supporters who have warned of his worsening health.
There’ve been growing calls by human rights activists and religious leaders for justice and rule of law to be observed.
Besgye’s legal team argue that his continued detention is unlawful while the state defends the Supreme Court ruling, saying it did not order for their release.
The High Court set 25th February to hear the case seeking for his unconditional release.
